Updated Legislation regarding PR options for TSS visa holders

On 17 March 2022, the Australian Government released new legislation which provides a pathway for Temporary Skill Shortage (TSS) (subclass 482) visa holders, including those on the short-term stream, to permanent residency via the Employer Nominated Scheme (subclass 186). Grandfathering provisions for holders of the Temporary Work (Skilled) visa (subclass 457) who held or applied for a subclass 457 visa on 18 April 2017 are also available under this new pathway.  

TSS visa holders will need to have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021 and will need to have worked for their nominating employer for at least 3 of the last 4 years. Applicants will need to meet additional criteria to be eligible for this pathway.
